POSH Act, 2013
Prevention of Sexual Harassment at the Workplace. Every working woman should know these rules.
What counts as workplace harassment?
Unwelcome physical contact, demands for sexual favours, sexually coloured remarks, showing pornography, and any unwelcome conduct of a sexual nature, whether physical, verbal or non verbal.
It applies to offices, factories, shops, homes where domestic workers work, and even work trips and online interactions.
The Internal Committee
Every employer with 10 or more employees must have an Internal Committee. You can file a written complaint within 3 months of the incident. The committee must complete its inquiry within 90 days.
If your workplace has fewer than 10 employees, or the complaint is against the employer, approach the Local Committee of your district.
Your protections
You can ask for a transfer, leave up to 3 months, or interim relief during the inquiry. Retaliation against a complainant is itself punishable. Your identity stays confidential by law.
