Domestic Violence Act, 2005
The Protection of Women from Domestic Violence Act. Your shield inside your own home, in plain English.
What counts as domestic violence?
The law covers physical, emotional, verbal, sexual and economic abuse by a husband, partner or any adult member of the household. Threats, insults, controlling money and denying basic needs all count.
You do not need visible injuries to seek protection.
What can the court give you?
A Protection Order that stops the abuser from contacting or harming you. A Residence Order that secures your right to live in the shared household. Monetary relief for expenses and losses. Temporary custody of your children.
How do I start?
Approach the Protection Officer of your district, a registered service provider, or file directly before a Magistrate. A complaint under this law is civil in nature, so you can seek protection without sending anyone to jail.
Keep any evidence you safely can: messages, medical records, photos, witness names.
