BNSS & BNS, 2023
The new criminal codes of India. What changed for women safety, FIRs and Zero FIR rights.
What replaced what?
The Bharatiya Nyaya Sanhita replaced the Indian Penal Code, and the Bharatiya Nagarik Suraksha Sanhita replaced the CrPC. Offences against women now sit in a dedicated chapter with stricter punishments.
Zero FIR is now law
You can file an FIR at any police station, anywhere in India, regardless of where the crime happened. The police cannot refuse. The FIR is then transferred to the correct station.
You can also file an e-FIR online for many offences, and a copy of the FIR must be given to you free of cost.
Stronger rights for survivors
Statements of women survivors are to be recorded by a woman officer where possible, at a place of the survivor choosing. Medical examination reports must reach the investigating officer within 7 days. Investigation in rape cases must finish within 2 months.
